Procedures
1. Receive a letter from the party requesting expropriation.
2. Directing a letter requesting expropriation to the director of the competent registration directorate depending on the location of the property, to do the following:
Perform field inspection on the piece to be expropriated,
Prepare a preliminary valuation for the plot, or the expropriated part thereof.
3. Directorate of Public Property / Expropriation Department shall address the expropriating party to provide the directory with a financial commitment document certified by the General Budget Department.
4. After receiving the financial document, an expropriation announcement shall be published in two daily local newspapers.
5. 15 days from the date of the announcement, the Prime Minister is addressed to issue a resolution from the Council of Ministers to approve the expropriation.
6. After the issuance of a resolution by the Council of Ministers to approve the expropriation, the competent registration directorate shall be addressed to do the following :
Place an "Expropriation Reservation" sign on the expropriated piece's bond.
Conduct the field inspection in conjunction with the delegate of the expropriating body and the director of finance of the affiliated area
Prepare a Committee of Origin report including a description of the piece and what it includes and a valuation of compensation due. Service Card 99 (All types of Expropriation and compensation).
7. The Transaction is transferred to the Directorate of Public Property / Expropriation Department where the sensory inspection is made by the qualified negotiation committee comprising of the Head of the Department of expropriation and the registration Director based on the affiliate Directorate, and the delegate of the expropriating party, where the agreement shall be reached with the owner on the value of compensation The Director General of the department of Lands and Survey shall sign the resolution made by the negotiation committee.
8. If the owner of the piece does not approve of the value of the compensation, the court shall be referred to.
9. If the owner approves the value estimated by the negotiating committee, the following shall be done:
Signing of the agreements by the concerned individuals, stating their approval of the estimated values based on the report of the committee of origin and the negotiation committee.
The negotiation agreement is approved by the Director General of the department of Lands and Survey and the Minister of Finance.
A letter is sent by the department to the expropriating party, to request a financial transfer in the name of the Director General of the department of Lands and Survey in addition to his job, of an amount equal to the compensation due to the owner.
Upon receiving the financial transfer from the expropriating party, the financial transfer is endorsed and transferred to the registration directorate concerned depending on the property's location letter shall be recorded according to the location of the piece and attached to the Directorate of the book, directed to the procedures of compensation. For the Registration Manager and Payment List
Signature of the owner or his agent on the payment list before the registration director.
Transfer of financial statements and endorsed check to the Ministry of Finance / Directorate of Finance for the purpose of cashing the check. Issuing an amendment warrant.
10. Registration of the expropriated plot in the name of the expropriating party and the area expropriated in case that the expropriating is for the Ministry of Public Works and Housing, Service Card 100 (All types of Expropriation and compensation). To be listed on the register's paper and the rights map and to place a "expropriation reservation" sign
